                Applicant: Roman Fajngold

                Block 232, Lots 1.01 and 1.02

(Phase II: Resubdivision, preliminary and final major site plan and use variance. Applicant is proposing to resubdivide two existing lots; the existing building and storage yard is to be demolished, and a new building is to be constructed for the same warehouse use with showroom/office/retail space, storage mezzanine and parking on Lot 1.02. Variances required for parking set back, the first 20 ft. adjacent to street line shall not be used for parking, 5 ft. is proposed adjacent to Route 35; the first 10 ft. adjacent to any lot line shall not be used for parking, 8 foot to the common boundary line with Block 232, Lot 3, is proposed; front yard parking not permitted, proposed is construction of curbs and paved parking spaces for 17 vehicles; loading requirements for office/warehouse, overhead door openings/spaces provide a vertical clearance of 9 ft. where 14 ft. minimum required; parking requirements, Lot 1.02 34 spaces required for warehouse/storage, 17 proposed along route 35. The new subdivision/development reduces the number of spaces on Lot 1.01 from 48 to 20 spaces; use variance required for warehouse/storage facilities  not permitted in the HC zone; pavement and curbing required on access driveway and aisles of parking areas and not provided beyond 47 ft.; land disturbance not to occur within 25 ft. of top of bank of any naturally occurring watercourse or within 50 ft., but proposed development shall occur on the boundary of proposed Lot 1.02, within steep slope areas and a minimum of 40 ft. from the top of bank; critical areas no land disturbance or removal of trees, etc. within 25 ft. of top of bank or any naturally occurring water course, or within 50 ft. of top of bank of any naturally occurring watercourse, and applicant proposes “0” for construction of storm sewer line; attached sign of 600 sq. ft. proposed over existing driveway attached to both buildings on Lot 1.01 and Lot 1.02, where 50 sq. ft. permitted. This proposed sign is a relocation of existing previously approved sign; loading zones, three proposed for Lot 1.02, four required; maximum building coverage 36.8% proposed for Lot 1.02, 25% permitted; free standing sign, 144 sq. each side proposed, 75 sq. ft. permitted. Applicant previously received minor subdivision with bulk variances and use variance approvals on Lots 1.01 and 1.02 in June, 2003).
